Welcome to supportingkids.org (the “Site”), operated by Supporting Kids Foundation (“SKF,” “we,” “us” or “our”), a 501(c)(3) nonprofit charity. These Terms of Use (the “Terms”) govern your access to and use of the Site. By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.
1. Use of the Site
You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:
- use the Site in any way that violates any applicable law or regulation;
- submit information that is false or misleading, or impersonate any person or organization;
- attempt to gain unauthorized access to the Site, to other users' accounts, or to the systems and networks that support the Site;
- interfere with or disrupt the Site, or introduce viruses or other harmful code;
- use any robot, scraper or other automated means to collect content or personal information from the Site without our written permission; or
- use the Site to send unsolicited communications or to solicit the families, donors, sponsors or volunteers we work with.
2. Accounts and sign-in
Some areas of the Site are available only to people we have invited, such as board members, sponsors, families and scholarship reviewers. If you are given access, you are responsible for keeping your sign-in links and credentials confidential and for activity that occurs under your access. Please tell us promptly if you believe your access has been used without your permission. We may suspend or end access to these areas at any time.
3. Donations
Donations made through the Site are processed by a third-party platform and are also subject to that platform's terms and privacy policy. Supporting Kids Foundation is a 501(c)(3) nonprofit charity (EIN 27-2386653), and donations are tax deductible to the extent allowed by law. We do not provide tax advice; please consult your own tax advisor. Donations are generally final and non-refundable. If you believe a donation was made in error, please contact us and we will work with you in good faith.
4. Assistance and scholarships
Information on the Site about our assistance programs and scholarships is provided for general information only. Submitting an application or request does not guarantee that you will receive assistance or an award. All decisions are made at the sole discretion of SKF, depend on eligibility and available funds, and are final. We may change or end any program at any time.
5. Content you submit
You may be able to submit content to the Site, such as a family story, photos, video, a profile or an application (“Your Content”). You keep ownership of Your Content. By submitting content that is intended for publication, such as a family story or a sponsor or board member profile, you give SKF a non-exclusive, royalty-free permission to use, reproduce, edit for length and clarity, display and share it on the Site, on our social media and in materials that support our charitable mission. You may ask us to remove published content at any time by contacting us, and we will remove it from the Site and our own accounts within a reasonable time; we cannot recall copies that others have already shared.
You confirm that:
- Your Content is yours to share and is accurate to the best of your knowledge;
- if Your Content includes information or images of a child, you are that child's parent or legal guardian and have the authority to share it;
- anyone else who is identifiable in Your Content has agreed to be included; and
- Your Content does not violate any law or the rights of any other person.
We may review, edit, decline to publish or remove any content at our discretion.
6. Intellectual property
The Site and its content, including text, graphics, logos, photographs and software, are owned by SKF or its licensors and are protected by copyright, trademark and other laws. You may view, download and print pages from the Site for your personal, non-commercial use, as long as you do not alter them or remove any notices. Any other use requires our prior written permission. Sponsor and partner names and logos belong to their respective owners.
If you believe content on the Site infringes your copyright, please contact us with a description of the work, where it appears on the Site and your contact information, and we will review it promptly.
7. Third-party sites and services
The Site contains links to websites and services operated by others, including our donation platform, event registration pages and social media. We provide these links for convenience only. We do not control and are not responsible for their content, products, services or privacy practices, and a link does not mean we endorse them.
8. No professional advice
Content on the Site, including family stories, is provided for general information only. It is not medical, legal, financial or tax advice and is not a substitute for advice from a qualified professional. Family stories reflect the personal experiences of the people who shared them. Always seek the advice of your physician or another qualified provider with any questions about a medical condition.
9. Disclaimer of warranties
THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, SKF DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, OR THAT ITS CONTENT IS ACCURATE, COMPLETE OR CURRENT.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SKF AND ITS DIRECTORS, OFFICERS, VOLUNTEERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, REVENUE OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
11. Indemnification
You agree to indemnify and hold harmless SKF and its directors, officers, volunteers, employees and agents from any claims, damages, losses and expenses, including reasonable attorneys' fees, arising out of your violation of these Terms, your misuse of the Site, or Your Content.
12. Governing law
These Terms are governed by the laws of the State of Kansas, without regard to its conflict of law rules. Any legal action arising out of or related to these Terms or the Site must be brought in the state or federal courts located in Kansas, and you consent to the jurisdiction of those courts.
13. Changes to the Site and these Terms
We may change, suspend or discontinue any part of the Site at any time. We may also update these Terms from time to time. When we do, we will post the updated version on this page and revise the “Last updated” date above. Your continued use of the Site after a change means you accept the updated Terms.
14. General
If any part of these Terms is found to be unenforceable, the rest will remain in effect. Our failure to enforce any part of these Terms is not a waiver of our right to do so later. These Terms, together with our Privacy Policy, are the entire agreement between you and SKF regarding the Site.
